Minutes of the July 27, 1999 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Town Hall, 93 Narragansett Ave.
      The meeting was called to order by the Vice-Chair at 7:03 p.m.  The
clerk called the roll and noted the following members present:

Thomas Ginnerty
Dennis Grieco
Guy Settipane
Don Wineberg
Raymond Iannetta

Fred Brown, Zoning Officer

MINUTES of June 22, 1999

Seated: Richard, Thomas, Dennis, Guy, and Don.
A motion was made by Don Wineberg and seconded by Dennis Grieco  to accept
the minutes of the June 22, 1999 amended on page #2 to read "Wineburg" to
"Wineberg", in paragraph #1 "issue" to "appearance" and "the appearance
of" to "representation of the Zoning Board by", eliminate paragraph #2,
and in paragraph #3 "added an amendment to the motion" to "moved" and
eliminate "amended".

The motion carried by a vote of 5 - 0.


A letter from Edward Holland requesting a 1 year extension of a special
use permit of Hammett Court Properties.

A motion was made by Dennis Grieco and seconded by Don Wineberg to grant
the request of Hammett Court Properties for a 1 year extension of a
special use permit granted August 25, 1998.

The motion carried by a vote of 5 - 0.



A motion was made by Don Wineberg and seconded by Guy Settipane to grant
the request of Marjorie Kazin-Boyce, whose property is located at Gondola
Ave., and further identified as Tax Assessor's Plat 16, Lot 356 for a
variance from Article 3, Section 308 (Setback from Freshwater Wetlands) to
locate an ISDS within 55'of a wetland feature instead of the required

The Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This variance is granted with the following restrictions:

1. Recommendation 2 through 5 of the conservation commission's letter to
the Zoning Board dated July 27, 1999 (Exhibit 6) are incorporated herein
by reference and imposed as conditions for the granting of the variance
except that the buffer zone referred to in recommendation 2 is 17 ft.
instead of 20 ft.

2. A copy of the plan for the proposed sewage disposal system submitted as
Exhibit 4 be filed in the land evidence records of the Town of Jamestown.

3. There shall be no construction or alteration of the area delineated in
the plan as the 50' perimeter wetland setback.

This motion is based on the following findings of fact:

1. Said property is located in a RR80 zone and contains 2.57 acres.

2. The conservation commission did not oppose granting the variance and
recommended conditions substantially incorporated in the decision.

3. Two neighborhood residents opposed the application.

4. The slope of the system requires careful attention to prevent erosion
and transmittal of pollutants into the groundwater system.

5. The applicant proposes use of a "state-of-the-art" system which
minimizes the size of the system which maintains public health and safety.

6. The plan and conditions require substantial planting to minimize
erosion and maintain the rural nature of the undeveloped portion of the

The motion carried by a vote of 4 - 1.

Dennis Grieco voted against the motion.

Independent Counsel

Richard Allphin recused himself.

Thomas Ginnerty now acting chair.

Seated: Thomas, Dennis, Guy, Don, and Raymond.

A motion was made by Don Wineberg and seconded by Dennis Grieco to ratify
the selection by Catherine Finney of Turner Scott as independent counsel
for the Zoning Board pertinent to the matter of Conanicut Marine Service
subject to negotiating compensation.

The motion carried by a vote of 5 - 0.


A motion was made to adjourn at 9:53 p.m.

The motion carried unanimously.
