JAMESTOWN ZONING BOARD OF REVIEW

  Minutes of the MAY 25, 1999 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Town Hall, 93 Narragansett Avenue.
      The meeting was called to order by the Chairwoman at 7:00 p.m.  The
clerk called the roll and noted the following members present:

Catherine Finney
Rolf Knudsen
Richard Allphin
Thomas Ginnerty
Dennis Grieco
Guy Settipane
Don Wineberg
Raymond Iannetta

A motion was made by Don Wineberg and seconded by Richard Allphin to
accept the minutes of Dec. 15, 1998 page #2 as written.  

The motion carried by a vote of 5 - 0.

OLD BUSINESS

A motion was made by Catherine Finney and seconded by Dennis Grieco to
continue the application of Conanicut Marine Services to the June 22, 1999
meeting to give the Town Council time to talk about the matter before it
is heard by the Zoning Board. 

The motion carried by a vote of 5 -0.

Siner

A motion was made by Catherine Finney and seconded by Dennis Grieco to
accept without prejudice the withdrawal of the application of Albert J.
Siner, whose property is located at 32 Narragansett Ave., and further
identified as Tax Assessor's Plat 8, Lot 164 for a special exception from
Article 6, Section 601 (Special Use Permits) to alter a previously granted
special use permit by adding an apartment above an existing garage.  

The motion carried by a vote of 5 - 0.

Dwyer

A motion was made by Catherine Finney and seconded by Dennis Grieco to
continue the application of John Dwyer to the June 1, 1999 meeting because
Mr. Dwyer was not present.

The motion carried by a vote of 4 - 1.

Thomas Ginnerty voted against the motion.

NEW BUSINESS

Ciabattoni

A motion was made by Catherine Finney and seconded by Richard Allphin to
grant the request of Joseph Ciabattoni, MD, whose property is located at
16 East Shore Rd., and further identified as Tax Assessor's Plat 7, Lot 50
for a variance from Article 7, Section 705 (Alteration of a Nonconforming
Structure) and Article 3, Section 302 (District Dimensional Regulations)
to enlarge 2nd floor bedroom by 109 sq. ft.  

This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This variance is granted with the restriction that the Zoning Board will
require that, upon any further relevant application to this Board, the
applicant shall show satisfactory evidence that the property's ISDS has
the capacity to operate at current standard.

This motion is based on the following findings of fact:

1. Said property is located in a R40 zone and contains 29,637 sq.    ft.

2. The nonconforming use of the property as two units is    long   
standing.
      This proposal does not increase the degree of         
nonconformity.

3. The proposal represents no increase in the foot print of the     
residence.
      The proposed alteration is minimal to bring the       property to
efficient use as a year round, primary residence for    the applicant.

4.  There were no objections.

The motion carried by a vote of 5 - 0.

Simonsen

A motion was made by Catherine Finney and seconded by Dennis Grieco to
continue the application of Eric Simonsen to the June 1, 1999 meeting at
the request of his attorney.

The motion carried by a vote of 5 - 0.

ADJOURNMENT

A motion was made to adjourn at 8:22 p.m.

The motion carried unanimously.
