  JAMESTOWN ZONING BOARD OF REVIEW

  Minutes of the DECEMBER 15, 1998 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Town Hall, 93 Narragansett Avenue.
      The meeting was called to order by the Chairwoman at 7:05 p.m.  The
clerk called the roll and noted the following members present:

MINUTES of November 24, 1998

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to
accept the minutes of the November 24, 1998 as written.

The motion carried by a vote of 5 - 0.

CORRESPONDENCE

Memo from the zoning clerk re: letters requesting reappointment of Dennis
and Tom.

C.R.M.C. Coastal Features Fall 1998 Volume VII, No. 3.

Client Alert from Partridge Snow & Hahn LLP re: "D-Day".

OLD BUSINESS 

Cannon

A motion was made by Raymond Ianetta and seconded by Thomas Ginnerty to
grant the request of Joseph Cannon Jr.
     et Gladys L., whose property is located at 276 Capstan St., and
further identified as Tax Assessor's Plat 3, Lot 131 for a variance from
Article 3, Section 302 (District Dimensional Regulations) to build an
addition to an existing house which will be 15" from the front lot line
instead of 40' required, and to construct a 2 car garage which will be 20'
from the front lot line instead of the required 40'.  

This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This variance is granted with the following restrictions:

1. No plumbing or water will be added to the garage and workshop.

2. Acoustical insulation will be installed in the workshop to sufficiently
minimize noise emanating from said workshop.

This motion is based on the following findings of fact:

1. Said property is located in an R40 zone and contains 23,504 square
feet.

2. 24 neighbors signed a petition in favor of the variance, 2 wrote
letters and 4 testified in favor of and four families were abutters.

3. The applicant needs relief to accommodate his family.

4. The garage is below grade and minimally intrusive to the neighbors.

5. The relief is minimal because the relief would still be needed if the
workshop and garage were added behind the house.

6. The building official stated it was possible to add the addition behind
the existing structure but was not practical.

7. The amount of setback relief requested is no more than currently
exists.

The motion is also based on the finding of law that paragraph 705 does not
prohibit the granting of variances for nonconforming structures.  

The motion carried by a vote of 5 - 0.

NEW BUSINESS

Netro

A motion was made by Richard Allphin and seconded by Thomas Ginnerty to
grant the request of Kristen Netro, whose property is located at America
Way and further identified as Tax Assessor's Plat 2, Lot 176 for a
variance from Article 3, Section 308 (Setbacks from Freshwater Wetlands)
to construct a single family house which will be 83' from a wetland
instead of the required 150'.  

This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This motion is based on the following findings of fact:

1. Said property is located in a RR80 zone and contains 87,120 sq. ft.

2. The applicant has received approval from the RI D.E.M. for the plan
submitted.

3. The proposed location for the septic system is for all practical
purposes the only possible location.

The motion carried by a vote of 5 - 0.

Ferguson

A motion was made by Thomas Ginnerty and seconded by Richard Allphin to
grant the request of George and Claire Ferguson, whose property is located
at 37 Bay View Dr., and further identified as Tax Assessor's Plat 8, Lot
261 for a variance from Article 3, Section 3-2 (District Dimensional
Regulations) to construct an addition 25' from the property line where 30'
is required.  

This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This motion is based on the following findings of fact:

1. Said property is located in a R20 zone and contains 35,130 sq. ft.

2. That the relief sought is a minor intrusion in the setback requirement
by 5 feet by a porch roof.

3. That no objectors were present.

The motion carried by a vote of 5 - 0.
