JAMESTOWN ZONING BOARD OF REVIEW
Minutes of the June 3, 1997 Meeting
A special meeting of the Jamestown Zoning Board of Review was held at
the Jamestown Town Hall, 93 Narragansett Avenue. The meeting was
called to order by the Chairwoman at 7:11 p.m. The clerk called the
roll and noted the following members present:

Also present were:
Jane Fitts, Stenographer
Pat Westall, Zoning Clerk
Fred W. Brown, Zoning Officer
Quentin Anthony, Town Solicitor
Seated: Catherine, Richard, Thomas, Guy, and Raymond.
MINUTES
MAY 20, 1997
The minutes were amended on page five to read: Section 302.
A motion was made by Richard Allphin and seconded by Thomas Ginnerty to
accept the minutes of the May 20, 1997 as amended.
The motion carried by a vote of 5 - 0.
OLD BUSINESS
Seated: Catherine, Richard, Thomas, Dennis, and Guy.
GLADDING
A motion was made by Richard Allphin and seconded by Dennis Grieco to
grant the request of Frank N. Gladding whose property is located at
Wright Lane and East Shore Rd. and further identified as Tax Assessor's
Plat 4, Lot 18 for a variance from Article 3, Section 308, (Setback
from Freshwater Wetlands) to install an ISDS 0 (zero) feet from a
freshwater wetland instead of the required 150 feet.
This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.
This variance is granted with the following restrictions:
1. The conservation easement that is part of the DEM approval must be
recorded in the land evidence records.
2. The "Declaration of Restrictions" must also be recorded.
This motion is based on the following findings of fact:
1. Said property is located in an RR80 zone and contains 54,500 +/- sq.
ft.
2. The applicant has an approved ISDS system signed off on by the RI DEM.
3. DEM entered into a consent agreement with the applicant (Appendix
"A") to the DEM approval which lists 18 conditions that must be met
in installing this system.
4. The Jamestown Conservation Commission recommended that the request
be denied.
5. No other person spoke against this request.
The motion carried by a vote of 4 - 1.
Thomas Ginnerty voted against the motion.

Dennis Grieco recused himself.
MITCHELL
A motion was made Richard Allphin and seconded by Thomas Ginnerty to
grant the request of Glen & Numi Mitchell whose property is located at
67 Howland Avenue, and is further identified as Tax Assessor's Plat 9,
Lot 191 for a variance from Article 3, Section 302, Table 3-2 (District
Dimensional Regulations) to install a bulkhead which will be 3.5 feet
from the right line instead of the required 7 feet.
This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.
This motion is based on the following findings of fact:
1. Said property is located in an R8 zone and contains 21,500 sq. ft.
2. This relief is the least that is necessary to allow access to the
basement when the addition is completed.
3. No one spoke against the granting of this variance.
The motion carried by a vote of 5 - 0.
BINGELL
A motion was made by Richard Allphin and seconded by Thomas Ginnerty to
continue the application of Alfred Bingell to the next regular meeting
June 24, 1997 at the request of the applicant.
The motion carried by a vote of 5 - 0.

HAMMETT COURT
A motion was made by Catherine Finney and seconded by Thomas Ginnerty
to continue the application of Hammett Court Properties to the next
reqular meeting June 24, 1997 due to the time and the time needed to
hear the rest of the case
The motion carried by a vote of 5 - 0.
ADJOURNMENT :
A motion was made by Thomas Ginnerty and seonded by Richard Allphin to
adjourn the meeting at 10:41.
