ZONING BOARD MINUTES
Meeting of October 22, 1996
Town Hall
Meeting came to order at 7:30 pm.
Roll was called by the Recording Secretary and the following
members were present:

APPROVAL OF MINUTES
A motion was made by Catherine Finney and seconded by Thomas
Ginnerty to accept the minutes of September 24, 1996 as written.
So voted: 5-0
CORRESPONDENCE:
(1) Mr. John Murphy informed the Board that Mr. Mirra has
withdrawn his application. A motion was made by Richard Allphin
and seconded by Thomas Ginnerty to withdraw the Mirra application
without prejudice. So voted, 5-0.
(2) Mr. John Murphy was present to speak for Mr. Chester N.
Salisbury on account of requesting a 1 year continuance on a
variance granted on October 11, 1995. A motion was made by
Richard Allphin and seconded by Catherine Finney to grant a one
(1) year continuance to Mr. Salisbury. This motion was granted
on the purpose of a ten (10) foot wide strip privacy buffer. So
voted, 5-0.
OLD BUSINESS
With nothing to report at this time move on to New Business.
NEW BUSINESS
1. Variance application of Susan Maffie Plowden. Ms. Plowden's
application was heard by Maurice Vandal, Catherine Finney,
Richard Allphin, Thomas Ginnerty, Dennis Grieco. Guy Settipane
was not seated.
A motion was made by Catherine Finney and seconded by Thomas
Ginnerty to grant the request of Susan Maffie Plowden whose
property is located at 28 Calvert Place and is further identified
as Tax Assessor's Plat 8, Lot 311 for a Variance from Article 3,
Section 302 (District Dimensional Regulations), Table 3-2, To
construct a garage addition to be 14 feet 10 inches from the rear
lot line instead of the required 30 feet, and to extend the front
porch to be 28 feet 6 inches from the front lot line instead of
the required 30 feet. This Board has determined that this
application DOES satisfy the requirements of Article 6, Section
606, Paragraph 1 through 4, and Section 607, Paragraph 2.
This Variance is granted with the following restriction(s):
(1) No exterior stairway shall be constructed to the "guest
suite" over the garage.
(2) No separate entrance shall be constructed to the "guest
suite" over the garage.
(3) No interior partitions shall be constructed over the
second floor which would preclude access to the
North/South stairway from the main section of the
residence.
(4) No doorway shall be constructed at the landing of the
east/west stairwell.
(5) Existing landscape buffers shall be maintained,
excluding plantings in the area of the proposed
structure.
This motion is based on the following findings of fact:
(1) The property is located in an R20 Zone and contains
19,979 sq. ft.
(2) The proposed addition is within the front and rear
setbacks of the existing home.
(3) The proposed garage will be cited in the approximate
location of the existing garage, which is in disrepair.
2. Variance application of Richard and Mary Byrd - Mr. and Mrs.
Byrd's application was heard from Maurice Vandal, Catherine
Finney, Richard Allphin, Thomas Ginnerty, Dennis Grieco. Guy
Settipane was not seated.
A motion was made by Richard Allphin and seconded by Dennis
Grieco to GRANT the request of Richard L. and Mary F. Byrd whose
property is located at 15 Windsor Street and is further
identified as Tax Assessor's Plat 9, Lot 136 for a VARIANCE from
Article 3, Section 302 (District Dimensional Regulations), Table
3-2, to construct a front porch 13 feet 16 inches from the front
of the lot line instead of the required 15 feet. This Board has
determined that this application DOES satisfy the requirements of
Article 6, Section 606, Paragraphs 1 through 4, and Section 607,
Paragraph 2.
This motion is based on the following findings of fact:
(1) The property is located in an R8 Zone and contains
6,600 sq. ft.
(2) The two adjacent structures have 5 foot and 8 foot
setbacks.
(3) Other than the applicant, no one spoke either in favor
of or against granting request.
3. Variance re-application of Marilyn Munger - Mrs. Munger's
application was heard by Maurice Vandal, Catherine Finney, Thomas
Ginnerty, Dennis Grieco, and Guy Settipane. Richard Allphin
recused himself.
A motion was made by Thomas Ginnerty and seconded by Guy
Settipane to grant Mrs. Munger a continuance due to a need for
additional data. So voted, 5-0.
Motion was made by Catherine Finney and seconded by Thomas
Ginnerty to adjourn the meeting at 11:00 pm.
