prejudice.

NEW
BUSINESS
A motion was made by Thomas Ginnerty and seconded by Don Wineberg to accept the withdrawal without prejudice of Patrick Kilroy at the request of his attorney, Turner Scott.
The
motion carried by a vote of 5 – 0.
Thomas
Ginnerty, Don Wineberg, Richard Boren, Joseph Logan, and David Nardolillo voted
in favor of the motion.

Wagner and Richard Cribb were not seated and Raymond Iannetta was absent.
A motion was made by Don Wineberg and seconded by Joseph
Logan to grant the request of Philip & Beth Steggall, whose property is
located at 41-43 Plymouth Rd, and further identified as Tax Assessor’s Plat 8,
Lot 558 for a variance from Article 3, Section 311 (Maximum Size of Accessory
Structures) to allow construction of a temporary Boat Shed which exceeds the
size allowed under the ordinance.
This Board has determined that this application does satisfy
the requirements of ARTICLE 6, SECTION 600, SECTION 606, and SECTION 607,
PARAGRAPH 2.
This Variance is granted with the following restrictions:
1.
The boat may only be worked on during the hours
of

The construction method may not release
noticeable odors or vapors from volatile organic compounds.
3.
The vacuum and heater fans shall face northward
or westward to minimize the noise heard by neighbors.
4.
The applicant will not permit people helping him
in construction of the boat to park on the street.
5.
This approval does not run with the land.
6.
This approval shall expire after 21 months
unless extended by the Zoning Board for good cause shown.
This motion is based on the following findings of fact:
1. Said property is located in a R8 zone and contains 10,084 sq. ft.
2.
The applicant independently notified neighbors
as did the Building Official and no neighbors objected. The applicant reported
that the neighbors were supportive.
3.
A motion was made by Don Wineberg and seconded by Joseph
Logan to amend the motion to add restriction #7. All construction materials
will be stored inside.
The
motion as amended carried by a vote of 4 – 1.
Thomas
Ginnerty voted against the motion.
Don
Wineberg, Richard Boren, Joseph Logan, and David Nardolillo voted in favor of
the motion.
Dean
Wagner and Richard Cribb were not seated and Raymond Iannetta was absent.
