JAMESTOWN ZONING BOARD OF REVIEW
Minutes of the April 23, 1996 Meeting
A regular meeting of the Jamestown Zoning Board of Review was held at
the Jamestown Town Hall, 93 Narragansett Avenue. The meeting was
called to order by the Chairman at 7:32 p.m. The clerk called the roll
and noted the following members present:

MINUTES
March 26, 1996
A motion was made by Rolf Knudsen and seconded by Thomas Ginnerty to
accept the minutes of the March 26, 1996 meeting as written.
The motion carried unanimously.
Seated: Maurice, Rolf, Richard, Thomas, and Dennis.
John Caito recused himself.
NEW BUSINESS
Flanagan
A motion was made by Rolf Knudsen to deny the request of Edward
Flanagan. It did not get a second and therefore was withdrawn.
A motion was made by Thomas Ginnerty and seconded by Richard Allphin to
grant the request of Edward Flanagan whose property is located at
Columbia Lane and further identified as Tax Assessor's Plat 2, Lot 152
for a variance from Article 3, Section 308 (Setback from Freshwater
Wetlands) to construct a septic system which will be 130 ft. from
freshwater wetlands instead of the required 150 ft.
This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4.
This variance is granted with the restriction that construction be
performed pursuant to the revised plan submitted 4/23/96.
This motion is based on the following findings of fact:
1. The property is located in a RR80 zone and contains 118,800 sq. ft.
2. That the plan complies with D.E.M.
3. That the request only requires a 20 foot change.
4. To conform to the 150 ft. requirement would require changes to the
contour of the land, potentially causing runoff to adjacent
property, and potential destruction of large old trees.
The motion carried by a vote of 4 - 1.
Rolf voted against the motion.
TEMPLETON-COTILL
A motion was made by Richard Allphin and seconded by Rolf Knudsen to
grant the request of Anna Templeton-Cotill whose property is located at
951 Ft. Getty Rd., and further identified as Tax Assessor's Plat 11,
Lot 7 for a variance from Article 3, Section 302 (District Dimensional
Regulations), and Article 7, Section 705 (Alteration of a Nonconforming
Structure) to alter the roof line of an existing nonconforming
structure which has an 8.75 ft. front setback where 40 ft. is required.

This Board has determined that this application does satisfy the
requirements of Article 6, Section 6-8, Paragraphs 1 through 4, and
Section 6-9, Paragraph 2.
This motion is based on the following findings of fact:
1. The property is located in a RR80 zone and contains 2+ acres.
2. The additional portion of the proposed structure will be
apporoximately 22 ft. from the front lot line.
3. The proposed addition will have a bedroom and bathroom, but no
kitchen, so will not become a "dwelling" unit.
4. A neighbor spoke in favor of granting the variance.
The motion carried by a vote of 5 - 0.
