JAMESTOWN ZONING BOARD OF REVIEW
Minutes of the January 4, 1996 Meeting
A special meeting of the Jamestown Zoning Board of Review was held at
the Jamestown Town Hall, 93 Narragansett Avenue. The meeting was
called to order by the Chairman at 7:30 p.m. The clerk called the roll
and noted the following members present:
Martin Hellewell,Chairman
Rolf Knudsen
Catherine Finney
Richard Allphin
John Caito
Thomas Ginnerty
Also present were:
Pat Westall, Zoning Clerk
Jane Fitts, Stenographer
James Donnelly, Town Solicitor
Thomas Ginnerty was sworn in as an alternate member by Mr. Hellewell.
OLD BUSINESS
Henrotin
John Murphy requested that the application of Clifford Henrotin be
continued to the January 23, 1996 meeting.
A motion was made by Richard Allphin and seconded by Rolf Knudsen to
continue the application of Clifford Henrotin to the January 23, 1996
meeting to allow the applicant time to get an elevation, survey and
engineering drawings to show accurate setbacks.
The motion carried.
Winoker
John Murphy requested that the application of James R. Winoker be
continued to the May 28, 1996 meeting.
A motion was made by Catherine Finney and seconded by Rolf Knudsen to
continue the application of James R. Winoker to the May 28, 1996
meeting to allow time for the applicant to go before the Planning
Commission and get ISDS approval.
The motion carried.
Aresti
Seated: Martin, Rolf, Catherine, Richard, and Thomas.
A motion was made by Rolf Knudsen and seconded by Richard Allphin to
grant the request of Ralph and Susan Aresti whose property is located
on Plat 2, Lot 10 for a variance from Article 3, Section 302 (District
Dimensional Regulations), to construct a single family home 40 feet
from the front lot line (40 ft. required), and 20 feet from the rear
lot line (40 ft. required).
This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.
This motion is based on the following findings of fact:
1. The property is located in a RR80 zone and contains 20,000 sq. ft.
2. An abutter objected to the front setback at 30 ft. and felt that the
40 foot setback should be maintained.
3. The application is for a modest house on this lot and because of the
size and shape of the lot it would be difficult to build even a
small home without a variance.
The motion carried with a vote of 4 - 1.
Martin Hellewell voted against the motion.
NEW BUSINESS
Potter
Spencer W. Potter requested that his application be continued to the
January 23, 1996 meeting.
A motion was made by Rolf Knudsen and seconded by Thomas Ginnerty to
continue the application of Spencer W. Potter to the January 23, 1996
meeting due to abutter misunderstandings about rescheduling dates
because of a snowstorm.
The motion carried.
Mariorenzi
Seated: Martin, Rolf, Catherine, Richard, and Thomas.
A motion was made by Rolf Knudsen and seconded by Thomas Ginnerty to
continue the application of Louis J. Mariorenzi and Priscilla Szneke to
the January 23, 1996 meeting to allow the applicant time to get more
information regarding standards for inground propane tanks and data to
substantiate that propane is not a pollutant if it leaks into the
ground.
The motion carried.
Applications
The Board reviewed the responsibilities of an applicant in filing for a
zoning variance, special exception and building code appeals.
A motion was made by Richard Allphin and seconded by John Caito to
substitute page 2 as corrected for paragraph 3 on the first page.
The motion carried.
