JAMESTOWN ZONING BOARD OF REVIEW

 

Minutes of the May 24, 2005 Meeting

 

 

A regular meeting of the Jamestown Zoning Board of Review was held at the Jamestown Library, 26 North Road.  The Chairman called the meeting to order at 7:04 p.m.  The clerk called the roll and noted the following members present:

Don Wineberg

Richard Boren

Elizabeth Brazil

MINUTES

 

 

Minutes of the April 26, 2005 meeting.

 

A motion was made by Thomas Ginnerty and seconded by Richard Boren to accept the minutes of the April 26, 2005 as presented.

The motion carried by a vote of 5 – 0.

 

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, Richard Boren, and David Nardolillo, voted in favor of the motion.

 

Elizabeth Brazil and Dean Wagner were not seated and Joseph Logan was absent.

 

 

 

 

CORRESPONDENCE

 

A letter from Mary Webster requesting a one-year extension of a previously granted variance.

 

A motion was made by Don Wineberg and seconded by Richard Boren to grant a one-year extension of a previously granted variance of Mary Webster.  

 

The motion carried by a vote of 5 – 0.

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, Richard Boren, and David Nardolillo, voted in favor of the motion.

 

Elizabeth Brazil and Dean Wagner were not seated and Joseph Logan was absent.

 

Arthur

 

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to continue the application of Doris Arthur to the June 28, 2005 meeting at the request of her attorney, Mark Liberati.

 

The motion carried by a vote of 5 – 0.

 

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, Richard Boren, and David Nardolillo, voted in favor of the motion.

 

Elizabeth Brazil and Dean Wagner were not seated and Joseph Logan was absent.

 

OLD BUSINESS

 

Sheehan

 

The application of Kerry Sheehan was withdrawn by the applicant.

 

 

 

NEW BUSINESS

 

Town of Jamestown

                                                                                                                     

A motion was made by Richard Boren and seconded by Thomas Ginnerty to continue the request of Town of Jamestown to the June 28, 2005 meeting to have the applicant go before the Planning Board.

 

The motion carried by a vote of 5 – 0.

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, Richard Boren, and David Nardolillo, voted in favor of the motion.

 

Elizabeth Brazil and Dean Wagner were not seated and Joseph Logan was absent.

 

 

Cingular Wireless

 

A motion was made by Thomas Ginnerty and seconded by Raymond Iannetta to continue the request of Cingular Wireless to the June 28, 2005 meeting to allow the applicant to come back with more information.

 

The motion carried by a vote of 5 – 0.

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, Richard Boren, and David Nardolillo, voted in favor of the motion.

 

Elizabeth Brazil and Dean Wagner were not seated and Joseph Logan was absent.

 

Bellion

 

A motion was made by Don Wineberg and seconded by Raymond Iannetta to grant the request of Dorothy G. & John M. Bellion, whose property is located at 22 Bay St., and further identified as Tax Assessor’s Plat 8, Lot 539 for a variance from Article 3, Table 3-2 (District Dimensional Regulations) to construct a front porch which will be 17.5 feet from the front property line instead of the required 30 feet.

 

This Board has determined that this application does satisfy the requirements of Article 6, Section 600, Section 606, and Section 607, Paragraph 2.

 

This motion is based on the following findings of fact:

 

1.     Said property is located in a R20 zone and contains 4,600 sq. ft.

2.     Front porches like this add visual beauty and social interaction to neighborhoods.

3.     One abutter spoke in favor.

4.     The porch only increases the proximity of the structure to the street by 8 feet.

 

The motion carried by a vote of 4 – 1.

 

Thomas Ginnerty voted against the motion.

 

Don Wineberg, Raymond Iannetta, David Nardolillo, and Elizabeth Brazil voted in favor of the motion.

 

Dean Wagner was not seated and Richard Boren and Joseph Logan were absent.

 

Robertson

 

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to continue the application of Susan Robertson to the June 28, 2005 meeting at the request of Mary Meagher representing the applicant, to come back with a request for lesser relief.

 

The motion carried by a vote of 5 – 0.

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, David Nardolillo, and Elizabeth Brazil voted in favor of the motion.

 

Dean Wagner was not seated and Richard Boren and Joseph Logan were absent.

 

Dolos

 

A motion was made by Thomas Ginnerty and seconded by Raymond Iannetta to continue the application of Maria Dolos to the June 28, 2005 meeting to have the applicant go before the Planning Board first.

 

The motion carried by a vote of 5 – 0.

 

 

Thomas Ginnerty, Don Wineberg, Raymond Iannetta, David Nardolillo, and Elizabeth Brazil voted in favor of the motion.

 

Dean Wagner was not seated and Richard Boren and Joseph Logan were absent.

 

ADJOURNMENT

 

A motion was made and seconded to adjourn at 9:15 p.m.

 

The motion carried unanimously.
