Minutes of the September 10, 2002 Meeting

A special meeting of the Jamestown Zoning Board of Review was held at the Jamestown Library, 26 North Rd. The meeting was called to order by the Chairman at 7:05 p.m. The clerk called the roll and noted the following members present:

MINUTES

Minutes of the August 27, 2002 meeting.

A motion was made by Richard Boren and seconded by Don Wineberg to accept the minutes of the August 27, 2002 meeting as presented.

The motion carried by a vote of 5 – 0.

CORRESPONDENCE

A letter from Robert D. Murray, Esq. representing an aggrieved party to the application(s) of Osprey Creek LLC, requesting the opportunity to submit a memorandum also, as did Mr. Liberati.

A motion was made by Kathleen Managhan and seconded by Richard Boren to grant the request of Robert Murray to submit a memorandum on or before September 20, 2002 and to continue the application of Osprey Creek LLC to the September 24, 2002 meeting.

The motion carried by a vote of 5 – 0.

Jamestown Place Associates

(Combined Lots)

A motion was made by Richard B. and seconded by Don Wineberg to grant the request of Jamestown Place Associates, whose property is located at 28 Narragansett Ave., and 35 Knowles Ct., further identified as Lots 488 and 562 on Tax Assessor’s Plat 8, for Special Use Permits under Article 6, Sections 600, 601, and 602, et al, to construct a ten unit residential condominium on a combined parcel of land which shall also have upon it a two unit commercial condominium building as shown on plans submitted. Said

This Board has determined that this application does satisfy the requirements of Article 6, Section 600 and 602.

This motion is based on the following findings of fact:

1. Said property is located in the CD zone, and contains 35,637 sq. ft. of land.

2. On 8/16/02, the Planning Commission unanimously voted to grant approval to Jamestown Place Condominium, LLC, with specific findings of facts and conditions of approval, which are incorporated by reference with these findings of fact.

3. The project as proposed meets all the dimensional requirements in a CD zone without necessity of any dimensional variance.

4. The comprehensive plans envision this type of mixed use.

5. The screening and buffering as testified to will be compatible with abutting areas.

6. The air conditioning system will be roof mounted with no unit greater than 8.0 decibels.

7. The project is a proper transitional use between a CD zone and a R20 zone.

The motion carried by a vote of 5 – 0.
