JAMESTOWN ZONING BOARD OF REVIEW

Minutes of the August 27, 2002 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the Jamestown Library, 26 North Rd. The meeting was called to order by the Chairman at 7:00 p.m. The clerk called the roll and noted the following members present:

MINUTES

Minutes of the July 23, 2002 meeting.

A motion was made by Don Wineberg and seconded by Raymond Iannetta to accept the minutes of the July 23, 2002 meeting as presented.

The motion carried by a vote of 5 – 0.

CORRESPONDENCE

A letter from Peter DiBiase requesting a continuance of his application to the September meeting.

DiBiase

A motion was made by Joseph Logan and seconded by Richard Boren to continue the application of Peter DiBiase to the Sept. 24, 2002 zoning meeting.

The motion carried by a vote of 5 – 0.

A fax to Fred from Joe Palumbo requesting a continuance of the application of Michael Dutton to the Sept. 24, 2002 zoning meeting.

A motion was made by Joseph Logan and seconded by Don Wineberg to continue the application of Michael Dutton to the Sept. 24, 2002 zoning meeting.

The motion carried by a vote of 5 – 0.

A letter from Bradford Swett requesting a one year continuance of a previously granted special exception.

Swett

A motion was made by Richard Boren and seconded by Joseph Logan to grant a one year continuance of a previously granted special exception to Bradford Swett, whose property is located at 45 Walcott Ave., and further identified as Tax Assessor’s Plat 9, Lot 300.

The motion carried by a vote of 5 – 0.

Jamestown Place Assoc. LLC

(Knowles Court)

Jamestown Place Assoc. LLC

(Narragansett Ave.)

Bernard A. Jackvony, attorney for the applicant, requested that Item #1 under Old Business (Jamestown Place Assoc. LLC, Narragansett Ave.), and Item #1 under New Business (Jamestown Place Assoc LLC, Knowles Ct.) be continued to the Sept. 24, 2002 meeting subject to the approval of Item #4 under New Business (Jamestown Place Associates, Combined Lots).

A motion was made by Richard Allphin and seconded by Don Wineberg to continue Item #1 under old business and Item #1 under new business to a later date.

No vote was taken.

Bernard A. Jackvony, Esq. requested that Item #1 under Old Business (Jamestown Place LLC, Narragansett Ave.) be withdrawn, (without prejudice) and Item #1 under New Business (Knowles Ct.) be continued to the Sept. 24, 2002 meeting.

A motion was made by Richard Allphin and seconded by Don Wineberg to accept the withdrawal of Item #1, (without prejudice) under Old Business (Jamestown Place LLC, Narragansett Avenue).

The motion carried by a vote of 5 – 0.

A motion was made by Richard Allphin and seconded by Don Wineberg to continue Item #1 under New Business (Jamestown Place LLC, Knowles Ct.) to the Sept. 24, 2002 meeting.

The motion carried by a vote of 5 – 0.

Osprey Creek, LLC

Seated: Richard A., Raymond, Richard B., Joseph, and Kathleen

Mark Liberati requested that Item # 3 under New Business (Osprey Creel, LLC, cont. from July) be withdrawn.

A motion was made by Kathleen Managhan and seconded by Richard Boren to accept the withdrawal of Item #3 under New Business (Osprey Creek, LLC, cont. from July).

The motion carried by a vote of 5 – 0.

Item # 7 under New Business, Osprey Creek, LLC (New Application) was heard and a decision will be made at the Sept. 10, 2002 special meeting.

Jamestown Place Associates

(Combined Lots)

After lengthy testimony and due to the late hour and the number of items on the agenda for the regular September 24, 2002 zoning meeting it was decided that a special meeting would be held on Sept. 10, 2002.

A motion was made by Don Wineberg and seconded by Richard Allphin to continue the application of Jamestown Place Associates (Combined Lots)to a special meeting September 10, 2002.

The motion carried by a vote of 5 – 0.

A motion was made by Richard Allphin and seconded by Richard Boren to continue the applications of Gary Lemery, Nancy Kolman Ventrone, Ramona Kelly, and John Collins to the September 24, 2002 meeting.

The motion carried by a vote of 5 – 0.

A motion was made and seconded to adjourn at 11:15 p.m.

The motion carried unanimously.
