JAMESTOWN ZONING BOARD OF REVIEW

Minutes of the November 27, 2001 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Library, 26 North Road.
      The meeting was called to order by the Chairwoman at 7:00 p.m.  The
clerk called the roll and noted the following members present:

MINUTES

Minutes of the October 23, 2001 meeting.

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to
accept the minutes of the October 23, 2001 meeting as presented.

The motion carried by a vote of 5 - 0.

CORRESPONDENCE

A letter to from Anne Veeger, Ph.D. URI dated October 24, 2001 re:USGS
national water-use web page.

A letter from Turner Scott dated October 24, 2001 re: Petition of Paul
Boghossian requesting a continuance to December 18, 2001.

A letter from Dick Wing dated November 16, 2001 requesting a continuance
of a previously granted variance.

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
deny the request of Richard Wing for a continuance of a previously granted
variance do to the fact that the variance had expired August 25, 2000. 

The motion carried by a vote of 5 - 0.

NEW BUSINESS

Boghossian

A motion was made by Catherine Finney and seconded by Dennis Grieco to
continue the appeal of Paul Boghossian re: Garden Terrace, to the December
18, 2001 meeting at the request of their attorney.

The motion carried by a vote of 5 - 0.

Liebhauser

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of Steven and Maria Liebhauser (Item #2 on the
agenda) to the December 18, 2001 meeting at the request of John Murphy,
attorney for the applicant.

The motion carried by a vote of 5 - 0.

Aynalem

After testimony was heard on the Aynalem application John Murphy requested
that the Board render a decision on that application before continuing
with the agenda because he was waiting for an expert witness for the next
item on the agenda.

A motion was made by Catherine Finney and seconded by Don Wineberg to
render a decision on Aynalem before continuing with the agenda.

The motion carried by a vote of 5 - 0.
 
A motion was made by Thomas Ginnerty and seconded by Richard Allphin to
grant the request of Shewaregan & Susan Aynalem, whose property is located
at 2 Clarke's Village Rd., and further identified as Tax Assessor's Plat
12, Lot 90 for a variance from Article 3, Section 3-2 (District
Dimensional Regulations) to construct a second floor addition 28' from the
front lot line instead of the required 30'.

This Board has determined that this application does satisfy the
requirements of Article 6, Section 600, Section 606, and Section 607,
Paragraph 2.

This motion is based on the following findings of fact:

1. Said property is located in a R40 zone and contains 11,250 sq. ft. 

2. That the existing house was mis-sited on the lot to be 28 ft. rather
than the required 30 ft.

3. That the proposed structure presents no further non-conformity as to
the existing footprint.

4. ISDS approval has been granted for three bedrooms.

5. There were no objectors.

The motion carried by a vote of 5 - 0

Slice of Heaven
  
A motion was made by Thomas Ginnerty and seconded by Dennis Grieco to
grant the request of Slice of Heaven, Inc., Tenant, and  Steven
Liebhauser, Maria Liebhauser and Dolores Ranaldi, Owners, for their
premises located at 32 Narragansett Ave., (further identified as Tax
Assessor's Plat 8, Lot 164) for a Special Use Permit under Article 6,
Section 603 Expiration and Extension of Special Use Permits; and Article
3, Table 3-1, VI, C. 3. Lunchroom or Restaurant (alcoholic beverages).
Applicant is seeking a Special Use Permit allowing the service of
alcoholic beverages at the existing 25 seat bakery/café. 

This Board has determined that this application does satisfy the
requirements of Article 6, Sections 600 and 602.

This Special Use Permit is granted with the condition that alcoholic
beverages shall not be dispersed after 12:00 a.m. and outside liquor
service shall be through table service.

This motion is based on the following findings of fact:

1. Said property is located in a CD zone and contains 7,500 sq. ft.

2. That the Town Council has previously granted the applicant a Class B
liquor license.

3. That Nathan Godfrey, a qualified real estate consultant testified that
the proposed use is consistent with surrounding uses and furthers the
intent of the comprehensive plan.

4. That the applicant testified that the serving of alcoholic beverages is
to support food services.

5. That the applicant shall not install or construct a bar area but limit
dispensing liquor pursuant to the zoning ordinance definition of lunchroom
or restaurant.

The motion carried by a vote of 5 - 0.

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to
adjourn at 8:20 p.m.
