***** UNAPPROVED MINUTES ***** JAMESTOWN ZONING BOARD OF REVIEW Minutes of the September 25, 2001 Meeting A regular meeting of the Jamestown Zoning Board of Review was held at the Jamestown Library, 26 North Rd. The meeting was called to order by the Chairwoman at 7:00 p.m. The clerk called the roll and noted the following members present: Catherine Finney Richard Allphin Dennis Grieco Don Wineberg Richard Boren Joseph Logan Also present: Brenda Hanna, Stenographer Pat Westall, Zoning Clerk Fred Brown, Zoning Officer Bruce Leach, Counsel MINUTES Minutes of the August 28, 2001 meeting. A motion was made by Don Wineberg and seconded by Dennis Grieco to accept the minutes of the August 28, 2001 meeting as presented. The motion carried by a vote of 5 - 0. CORRESPONDENCE A letter from Turner Scott requesting to withdraw from consideration before the Board the appeal of Paul Boghossian regarding the placement of the garage foundation. A letter from Turner Scott requesting to continue the appeal of Paul Boghossian regarding the maintenance of a landscaped stone terrace to the October 23, 2001 meeting. Boghossian A motion was made by Richard Boren and seconded by Joseph Logan to continue the appeal of Paul Boghossian regarding the garden terrace to the October 23, 2001 meeting. The motion carried by a vote of 5 - 0. Coastal Features Volume 10, Issue 1. NEW BUSINESS Seated: Catherine, Richard A., Dennis, Don, and Richard B. Nann A motion was made by Richard Boren and seconded by Don Wineberg to grant the request of Peter A. Nann, and Evelyn C. Nann, whose property is located at 120 East Shore Rd., and further identified as Tax Assessor's Plat 7, Lot 177 for a variance from Article 3, Section 3.11, Maximum Size of an Accessory Structure, to construct a garden shed of 240 sq. ft. which exceeds the total allowable of 600 sq.ft. for all accessory structures as shown on plans submitted. This Board has determined that this application does satisfy the requirements of Article 6, Section 600; Section 606, Paragraphs 1 through 4; and Section 607, Paragraph 2. This variance is granted with the restriction that the shed be of the same exterior materials as the house under construction. This motion is based on the following findings of fact: 1. Said property is located in a R40 zone and contains 25,930 sq. ft. 2. The proposed shed is 240 sq. ft. and backs up to woods. 3. There are no objectors. 4. The house is presently under construction and the shed will be of the same exterior materials. The motion carried by a vote of 5 - 0. Catherine Finney recused herself and Richard Allphin took over the meeting. Seated: Richard A., Dennis, Don, Richard B., and Joseph. Templeton-Cotill A motion was made by Dennis Grieco and seconded by Richard Boren to grant the request of Anna Templeton-Cotill, whose property is located at 168 Beavertail Rd., and further identified as Tax Assessor's Plat 11, Lot 23 for a variance from Article 7, Section 709 B (Adjacent Nonconforming Lots of Record Under Same Ownership), to permit lot 23 to returned to its historic configuration as depicted in the plans submitted with the application. This Board has determined that this application does satisfy the requirements of Article 6, Section 600; Section 606, Paragraphs 1 through 4; and Section 607, Paragraph 2. This variance is granted with the following restrictions: 1. The applicant shall obtain such relief as may be needed from the Planning Department or Commission as required to return lot 23 to its historic configuration as depicted in the plans submitted with the application. 2. A deed of conservation easement in substantially the form of Exhibit 1 will be properly executed and recorded in the Town's land evidence records. This motion is based on the following findings of fact: 1. Said property is located in a RR80 zone and contains 42,147 sq. ft. 2. The property is surrounded on two sides by land subject to conservation easements. 3. The property will continue in its historic configurations as a result of the granting of this application. The motion was amended to add a fourth finding of fact. 4. Requiring the applicant to divide an additional acre from lot 45 to add to lot 23 would remove additional land subject to the conservation easement on lot 45 and therefore be inconsistent with the Comprehensive Plan's goal to preserve open space. The amended motion was made by Dennis Grieco and seconded by Richard Boren. The amended motion carried by a vote of 5 - 0. Seated: Catherine, Richard A., Dennis, Don, and Richard B. McIntyre Testimony was heard on the application of Ruth D. McIntyre/J. Patrick McIntyre. A motion was made by Catherine Finney and seconded by Richard Allphin to continue the application to the October 23, 2001 meeting to allow the applicant to prepare drawings showing the present garage and proposed garage height. The motion carried by a vote of 5 - 0. ADJOURNMENT A motion was made to adjourn at 8:30 p.m. The motion carried unanimously.
