JAMESTOWN ZONING BOARD OF REVIEW

  Minutes of the October 24, 2000 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Library, 26 North Road.
      The meeting was called to order by the Chairwoman at 7:04 p.m.  The
clerk called the roll and noted the following members present:

MINUTES

Minutes of the September 19, 2000 meeting.

A motion was made by Thomas Ginnerty and seconded by Don Wineberg to
accept the minutes of the September 19, 2000 meeting as presented.

The motion carried by a vote of 5 - 0.

Minutes of the September 26, 2000 meeting.

A motion was made by Thomas Ginnerty and seconded by Joseph Logan to
accept the minutes of the September 26, 2000 meeting as presented.

The motion carried by a vote 5 - 0.

CORRESPONDENCE

A survey from URI Cooperative Extension Service re: training on land use
issues. 

A letter of 10/20/00 from Quentin Anthony re: Sheahan application.

A letter of 10/16/00 from Robert Falvey re: Swain application.

A letter of 10/19/00 from James Hyman re: Swain application.

OLD BUSINESS

Swain

A motion was made by Catherine Finney and seconded by Richard Allphin to
continue the application of David Swain to the November 28, 2000 meeting
because the engineer who prepared the site plan drawings was not able to
attend this evening's meeting.

The motion carried by a voted of 5 - 0. 

NEW BUSINESS
 
RIZZO

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of Donna M. Rizzo to the November 28, 2000
meeting because they did not receive DEM approval yet. 
 
The motion carried by a vote of 5 - 0.

OULLETTE

A motion was made by Richard Allphin and seconded by Dennis Grieco to
grant the application of Douglas E. Ouellette et ux Tracy L., whose
property is located at 29 Pemberton Ave., and further identified as Tax
Assessor's Plat 8, Lot 585 for a variance from Article 3, Section 302
(District Dimensional Regulations) to construct a 26 x 20 addition 20 feet
from the front lot line instead of the  required 30 feet. 

This Board has determined that this application does satisfy the
requirements of Article 6, Section 606, Paragraphs 1 through 4, and
Section 607, Paragraph 2.

This motion is based on the following findings of fact:

1. Said property is located in a R20 zone and contains 21,875 sq. ft. 

2. The addition will have the same setback as the existing house.

3. The Oullettes need additional space for a growing family.

4. If the addition is built 30 feet back, it would interfere with a dug
well on the property.

5. No one spoke against granting the variance.

The motion carried by a vote of 5 - 0.

SYLVIA

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of Adio Family Trust/John J. Sylvia et ux Barbara
J. to the November 28, 2000 meeting to have the applicant provide medical
documentation.

The motion carried by a vote of 5 - 0.

YOLE

A motion was made by Thomas Ginnerty and seconded by Dennis Grieco to
grant the request of Alfred & Anne Yole Jr., whose property is located at
24 West Passage Dr., and further identified as Tax Assessor's Plat 8, Lot
859 for a variance from Article 3, Section 302 (District Dimensional
Regulations) and Section 306 (Authorized Departures From Yard Regulations)
to store a recreational vehicle 10 ft. from the side lot line and 26 ft.
from the front line instead of the required 20 and 40 ft.
 
This motion is based on the following findings of fact:

1. Said property is located in a R40 zone and contains 43,000 sq. ft.

2. The applicant has failed to demonstrate that he has no reasonable
alternative to placement of the RV in a legally permissible location on
his property.

3. Neighbors objected to the application.

The motion did not carry by a vote of 0 - 5. 

SHEAHAN

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of Gail M. Sheahan to the November 28, 2000
meeting at the request of Quentin Anthony who was unable to attend this
evening's meeting.

The motion carried by a vote of 5 - 0.

ADJOURNMENT

A motion was made by Catherine Finney and seconded by Dennis Greico to
adjourn at 8:40 p.m.

The motion carried unanimously.
