  Jamestown Zoning Board of Review

 Minutes of October 3, 2000 Meeting
  
  A special  meeting of the Jamestown Zoning Board of Review was held at
the Jamestown Public Library, Jamestown, R.I. The meeting was called to
order by  the Chairperson, Ms. Finney, at 7:00 P.M. Ms. Finney called the
roll, and the following members were present:

 Catherine Finney, Chairperson
 Richard Boren
 Thomas Ginnerty
 Dennis Grieco
 Don Wineberg
 Richard Allphin
  
  Also present were :

 Fred Brown, Zoning Officer
 Christopher Zangari, Assistant Solicitor
  
  Application of Conanicut Marine Services, Inc.
  
  A motion was made by Catherine Finney and seconded by Richard Boren to
grant the request of Conanicut Marine Services, as Lessee, and William and
Marilyn Munger, as owners, for relief (a dimensional variance) from the
provisions of Section 1202 of the Zoning Ordinance, which requires that
parking for a use be  located on the same lot as that use, or on an
abutting lot.
      Applicants seek permission to provide off-site parking for their
marina uses on and adjacent to Lot 171 on Tax Assessor's Plat 8, and Lots
354, 355, 356, 595 and 791 on Tax Assessor's Plat 9.  These lots are all
located off Conanicus Avenue in the East  Ferry/Memorial Square area.
  
  The following findings of fact were determined:
  
  1.  This application is not relevant to the existing use of the subject
properties as presently configured.  This request is not necessary to the
concurrent special use permit application brought forth by the applicant
for expansion of off-site parking, per counsel to the Zoning Board of
Review.

  2.  The applicant suffers no hardship. The properties which are the
subject of this application enjoy legally permitted, beneficial uses.
  
  3.  The uses and configuration of these properties are longstanding and
well established. Denial will not amount to more than a more
inconvenience.
  
  Richard Boren voted in favor of the motion.
  
  Catherine Finney, Thomas Ginnerty, Dennis Grieco and Don Wineberg voted
to deny the motion.
  
  Richard Allphin recused himself, and Raymond Ianetta and Joseph Logan
were absent.
  
  The motion did not carry by a vote of 1 - 4.
  
  A motion was made by Dennis Grieco and seconded by Thomas Ginnerty to
grant the request of Conanicut Marine Services, Inc., and Marilyn A. and
William S.  Munger for a Special Use Permit under Section 603 of the Town
of Jamestown Zoning Ordinance, seeking, pursuant to Section 301, Table
3-1, V3, permission for seasonal off-site marina parking for 250 vehicles
on Lot 278 of Tax Assessor's Plat 8.  Said property is located in a R20
zone and contains approximately 424,317 square feet.
      The relief requested would amend a Special Use Permit granted to
applicants in a letter decision dated May 4, 1994.
  
  This motion is based on the following findings of fact:
  
  1.  Said property is located in an R20 zone and contains approximately
424,317 square feet.
  
  2. The testimony of James Salem was internally contradictory, without
basis and incredible and, therefore, is entitled to no weight.
  
  3.  The opinions of Peter Merritt, submitted by affidavit only, were
without factual basis and not given any weight.
  
  4.  The applicant has failed to prove the relief sought would not create
traffic conditions that would be inimical to public safety and welfare of
substantially injurious to the surrounding neighborhood, nor satisfy
Article 6, Sections A, B, and E.
  
  5.  The applicant has failed to prove that the relief sought would not
be otherwise inimical to the surrounding neighborhood and to the public
welfare.
  
  6.  The applicant failed to show that the shuttle system necessary to
carry customers from Taylor Point to its marine facilities would not be
inimical and  substantially injurious to the surrounding neighborhood.
  
  7.  Paragraph 1(a) of this board's 5/4/94 decision is a condition
imposed by this board in granting the relief in that decision.
  
  8.  The applicant has failed to show a change in circumstances regarding
this board's 5/4/94 decision and the neighborhood at issue.
  
  9. The board relies upon and incorporates by reference the record of the
proceedings on the application.
  
  The motion did not carry by a vote of 1 - 4.
  
  Richard Boren voted in favor of the motion.
  
  Catherine Finney, Thomas Ginnerty, Dennis Grieco and Don Wineberg voted
to deny the motion.
  
  Richard Allphin recused himself, and Raymond Ianetta and Joseph Logan
were absent.
