Minutes of September 26, 2000 Meeting
    
A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Public Library, Jamestown, R.I. The Meeting was called to order
by the Chairperson Ms. Finney at 7:04 P.M. The Stenographer called the
roll, and the
following members were present:

Catherine Finney, Chairperson
Richard Allphin
Thomas Ginnerty
Don Wineberg

Richard Boren
Joseph Logan

Minutes:

August 22, 2000

Motion made by Thomas Ginnerty and seconded by Don Wineberg to accept the
minutes of the August 22, 2000 meeting. Motion carried 5 - 0.
    
1.  variance application of Teresa Salk

MS. FINNEY: I would entertain a motion with regards to the application of
Teresa Salk.

MR. ALLPHIN: I move we grant the request of Teresa Salk whose property is
located 20 Seaview Avenue as further identified as Tax Assessor's plat 7,
lot 8, variances from Article III, Section 302, district dimensional
regulations to construct alterations to existing garage roof, which would
be 14 feet from the southerly lot line instead of required twenty feet.
     This Board determines this application does satisfied the
requirements of Article 6, Section 606, Paragraph 1 through 4, and Section
607, Paragraph 2.

This motion based on the following finding of facts:

1. Said property is in R 40 zone and contains 1.2  acres.

2. The footprint of the house and garage will not be increased.

3. If the garage were moved to the other side of the house, a neighbor's
view will be spoiled.

4. No one objected to the granting of this request.

MS. FINNEY: Okay, there is a motion. Is there a second?

MR. GINNERTY: Second.

MS. FINNEY: Seconded by Mr. Ginnerty. Is there any discussion on the
motion? (No response) All in favor?

MS. FINNEY: Aye.

MR. ALLPHIN: Aye.

MR. WINEBERG: Aye.

MR. BOREN: Aye.

FINNEY: All opposed?

 MS. FINNEY: Motion carries 5 - 0.
    
 2. Variance ampli-C-ation of Michelle Layman

MS. FINNEY: I will entertain a motion with regards to the variance
application of Michelle Layman.

MR. GINNERTY: I move we grant the request of Michelle Layman, 929 North
Main Road, further identified as Tax Assessors plat 3, lot 45 from Article
6, Section 302, district dimensional regulations to build an addition to
the existing building to extend beyond the setbacks, a 10 feet by 10 feet
square on the north corner of lot 45.

The Board determine this application does satisfy the requirement of
Article 6, Section 606, Paragraph 1 through 4 and Article 607, Paragraph
2.

The variance is granted with the following restrictions:

1. No living space and office space be provided above the garage.
    
This motion is based on the following findings of facts: The property is
in a R 40 zone.
     it contains 21,960 square feet.
     The configuration of the parcel increases the restriction as to the
position of the garage, and the septic location on the east side further
restricts location of the garage. No objection to the application.

MS. FINNEY: The motion is made. is there a second?

MR. ALLPHIN: Second.

MS. FINNEY: Seconded by Mr. Allpin. Any discussion on the motion? Do you
want to add in there that a three bedroom septic system has been approved
by DEM? I don't know if it was presented.

MR. GINNERTY: I don't think it is necessary.

MS. FINNEY: Okay, any further discussion on the motion? (No response)

All in favor of the motion?

MR. WINEBERG: Aye.

MR. IANNETTA: Aye.

MS. FINNEY: Aye.

MR. ALLPHIN; Aye

MS. FTNNEY: All opposed?  (No response)

MS. FINNEY: Motion carries 5 - 0.
    
3.  Variance application of Elizabeth Hazard

MS. FINNEY: I will entertain a motion with regards to the variance
application of Elizabeth Hazard.

MR. IANNETTA: I move we grant the request of Elizabeth Hazard whose
property is located at 24 Emerson Road, further identified as Tax
Assessors plat 86, lot 33 for a variance from Article 3, Section 302,
district dimension regulations to make alterations to an existing roof,
which will be 21 feet 6 inches from the    rear lot line instead of the
required 30 feet.

The Board has determined that this paragraph does satisfy the requirements
of Article 6, Section 606, Paragraph I through 4, and Section 607,
Paragraph 2.

This variances is granted with the following restrictions

There will be no increase in the footprint to the existing building.

This motion is based on the following finding of facts:

1.  Said property is in an R 20 zone and contains 25,800 square feet.

2.  There is no basement in the existing building, and the owners are
requesting a variance to enclose the existing porch and re-roof the
existing utility room to create further space.

3.  Further the present roof of the existing porch and utility room is
leaking.

4.  Two abutters spoke in favor of the application, one only if the for
existing        footprint was not enlarged.

5.  No one spoke against the petition.

MS. FINNEY: Motion is made. Is there a second?

MR. GINNERTY: Second.

MS. FINNEY: second by Mr. Ginnerty. All in favor.

MR. WINESERG: Aye.

MR. GINNERTY: Aye.

MS. FINNEY: Aye.

MR. ALLPHIN: Aye.

MS. FINNEY: All opposed? (No response)

Motion carries 5 - 0.
    
4. Variance application of CMS

MS. FINNEY: I will entertain a motion on the variance application of CMS.

MR. BOREN: I move we grant the request of Connanicut Marine Services and
Marilyn Munger, whose property is located at 20 Narragansett Avenue and
Knowles Court, and designated as lots 166, 175, 602, and Tax Assessors
plat 8 for a    dimensional variances under Article 6 to permit thirty-one
on-site parking spaces as delineated on exhibit #3, rather than 41 as
required pursuant to section 1203.

This Board has determined this application does satisfied the requirement
of Article 6, Section 606, Paragraph I through 4, and Section 607,
Paragraph 2.

This variance is granted with the following restrictions:

1.  All nine conditions of the Planning Commission be complied with
including no        parking in front, two spots in particular.

2.  In addition to the nine conditions, designated and dedicated parking
spaces be limited to four hours time limited by appropriate signage and
enforcement.

3.  The granting of this variances is specific to this building, and may
not be used to support the parking requirements of any other property.
    
This motion is based on the following finding of facts:
    
1.Said property is CD zone contains 7,016 square feet.

2.Proposed use is in fact a change in use which requires a variance
pursuant to        Article 12.

3.  No change in the size of the building.

4.  No objectors to the application.

5.Granting the relief will serve to advance the object of the zoning
ordinance, and

6.  It is the minimum relief necessary.
    
MS. FINNEY: There is a motion made. Is there a second on the motion?

MS. FINNEY: Seconded by Mr. Wineberg.
