  JAMESTOWN ZONING BOARD OF REVIEW

  Minutes of the February 22, 2000 Meeting

A regular meeting of the Jamestown Zoning Board of Review was held at the
Jamestown Town Hall, 93 Narragansett Ave.
      The meeting was called to order by the Chairwoman at 7:00 p.m.  The
clerk called the roll and noted the following members present:

Catherine Finney
Richard Allphin
Thomas Ginnerty
Dennis Grieco
Don Wineberg                         
Richard Boren
Joseph Logan

Also present were:

Jane Streeter, Stenographer
Pat Westall, Zoning Clerk
Fred Brown, Zoning Officer
Christopher Zangari, Counsel

Seated: Catherine, Dick, Tom, Dennis, and Don.

Minutes of the January 18, 2000 meeting.

A motion was made by Thomas Ginnerty and seconded by Dennis Grieco to
accept the minutes of the January 18, 2000 meeting corrected to add on
page 1 under #1.
     "A presentation was made by Gordon Cleary representing James Estes.",
and also under #1 to remove "is" in paragraph 2 after motion.

The motion carried by a vote 5 - 0.

Minutes of the January 25, 2000 meeting.

A motion was made by Thomas Ginnerty and seconded by Dennis Grieco to
accept the minutes of the January 25, 2000 meeting as presented.

The motion carried by a vote of 5 - 0.

CORRESPONDENCE

Fall 1999 Coastal Features Volume 8, Number 1.

A copy of a letter to the Town Council from Guy Settipane re: his position
on the Zoning Board.

A copy of a letter to Misters Boren, Wineberg, Ianetta, and Logan from the
town clerk re: appointments to the Zoning Board

SETTIPANE

A motion was made by Catherine Finney and seconded by Richard Allphin to
accept, with regrets, the resignation of Guy Settipane and to send a
letter of appreciation.
      The Zoning Board extends thanks and appreciation and acknowledges
the contribution he has made while serving on the Zoning Board. 

The motion carried by a vote of 5 - 0.

NEW BUSINESS

Seated: Catherine, Richard A., Thomas, Don, and Richard B.

BUCKLIN

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of William Bucklin to the March 28, 2000 meeting
at the request of the attorney for the applicant.

The motion carried by a vote of 5 - 0.

CMS

A motion was made by Catherine Finney and seconded by Don Wineberg to
continue the application of Conanicut Marine Services.
     to a special meeting on April 4, 2000 at the Jamestown Library at the
request of their attorney.
      CMS has filed a variance application which needs to be heard first
therefore the variance application will be heard before the special use
permit application.

The motion carried by a vote of 5 - 0.

BLACKWOOD

A motion was made by Thomas Ginnerty to deny the appeal of Colleen and
Richard Blackwood regarding the Zoning Officer's "Notice of Violation"
issued November 26, 1999 concerning property at 15 Dory Street and also
known as lot 152 on Tax Assessor's Plat 3.

After some discussion Mr. Ginnerty withdrew his motion.

A motion was made by Dennis Grieco and seconded by Don Wineberg to deny
the appeal of Colleen and Richard Blackwood regarding the Zoning Officer's
"Notice of Violation" issued November 26, 1999 concerning property at 15
Dory Street and also known as lot 152 on Tax Assessor's Plat 3.

This motion is based on the following findings of fact:

1. The deck, as stipulated by the parties, is 3' from the property line
where 10' is required.

2. The deck was permitted by the Town in 1977 as indicated in applicant's
Exhibit #1, based on erroneous information in the application for that
permit.
      Specifically, the house was represented as 30' wide in the plan
attached to the application when it was actually 38' wide.

The motion carried by a vote of 5 - 0.

A motion was made to adjourn at 8:30 p.m.

The motion carried unanimously.
