Jamestown Zoning Board of Review

Minutes of the January 25, 2000 Meeting

A regular meeting of the Zoning Board of Review was held at the Jamestown
Town Hall, 93 Narragansett Avenue.
     The meeting was called to order by the Chairwoman at 7:04 pm.
     The clerk called the roll and the following members were present:

Catherine Finney
Richard Allphin
Thomas Ginnerty
Dennis Grieco
Guy Settipane
Don Wineberg
Raymond Iannetta

Also present:

Kimberly Turcone, Recording Clerk
Fred Brown, Zoning Officer
Larry Parks, Town Solicitor
Turner Scott, Special Counsel to the Zoning Board

I.   Reading and Approval of Minutes from November 23, 1999.
A motion was made by Thomas Ginnerty and seconded by Dennis Grieco to
approve the
minutes from November 23d as written.  Motion carried by a vote of 5-0.

  II.   Reading and Approval of Minutes from December 14, 1999.
A motion was made by Don Wineberg and seconded by Thomas Ginnerty to
approve the
minutes from December 14th as written.  Motion carried by a vote of 5-0.

III. Correspondence
  a. A letter from Mary Brennan RE: Spencer Potter was read into the  
record.
  b. A notice from RIDEM #99-0262 RE: Alterations to the wetlands  
abutting North Pond was read into the record.

IV.  Old Business

Attorney John Murphy requested a continuance for the Special Use Permit
for Paws &
Claws.

  a. Special Use Permit of Paws & Claws 

Seated: Catherine, Richard, Tom, Dennis & Guy

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
continue the application of Paws & Claws to the March 28h Zoning Board of
Review hearing. Motion carried by a vote of 5-0.

  b. Deliberation of Items 2 & 3 of CMS Appeal and Schedule a Date for the
CMS Variance Application

Seated: Catherine, Tom, Dennis, Guy & Don

Recused: Richard & Ray

Attorney John Murphy stated that his client would like to withdraw the
appeal regarding the Zoning Official's decision.

After some discussion a motion was made and amended by Guy Settipane and
seconded by Don Wineberg to grant the request of Conanicut Marine
Services, Marilyn Munger and Ferry Wharf Condominium East Association to
withdraw appeal numbers 2 & 3 regarding the Zoning Officer's response to
items 2 and 3 of the Conanicut Marine Services request for zoning
certificates dated August 4, 1999.

The above withdrawal pertains to lots 354 and 791 on Tax Assessor's Plat
9, and Lot 602 of Tax Assessor's Plat 8, in the Town of Jamestown.

Motion carried by a vote of 5-0.

A motion was made by Don Wineberg and seconded by Dennis Grieco to allow
Conanicut Marine Services and Marilyn Munger to withdraw the Zoning
Application for a variance to construct additional piers and wavescreen
whose property is identified as lots 354 & 791 on Tax Assessor's Plat 9,
and lot 602 of Tax Assessor's Plat 8 in the Town of Jamestown.

Motion carried by a vote of 5-0.

V.   New Business

a.   Variance application of William Bucklin Seated: Catherine, Richard,
Tom, Dennis & Guy

A motion was made by Catherine Finney and seconded by Richard Allphin to
continue the hearing to the February 22, 2000 meeting.
     Motion carried by a vote of 5-0.

b.   Building Code Appeal of Charles VanVoorhis Seated: Catherine,
Richard, Tom, Guy & Ray

A motion was made by Catherine Finney and seconded by Thomas Ginnerty to
DENY the appeal of Charles VanVoorhis, AIA, for a variation or
modification of the application of the requirements of Sections
23-27.3-106.0 Paragraph 2 of the State Building Code, in reference to the
property located at 15 Calvert Place, Assessor's Plat 8, Lot 239.

This motion is based on the following findings of fact:

1.   The Zoning Board is in agreement with the Building Inspector's
interpretation that this property is subject to Section 23-27.3-106.2 of
the Building Code. As such, the stairs must be brought up to code.

Motion carried by a vote of 5-0.

The meeting of the Zoning Board of Review adjourned at 9:48 pm.
