PLANNING COMMISSION MINUTES
May 19, 1999

 Jamestown Town Hall

Meeting was called to order at 7:36 pm and the following members were
present:

I.  Reading and Approval of Minutes from May 5, 1999
A motion was made by Commissioner Webster and seconded by Commissioner
Smith to amend the minutes from May 5th.  Amendments are as follows:
  Page 2: Section V; Old Business (a) change the paragraph starting with
"Discussion" to
                         remove under page 3 "regarding maintenance..."
and read "Section (g) change 'a
                         minimum of two' to 'a minimum of four' regarding
maintenance at the
                         intersection with Hamilton Avenue."
  Page 3: Section V; Old Business (a) change Commissioner Lambert's vote
from "Aye" to
                         "Nay".
 So voted:

Gary Girard - Abstain        Mary Brennan - Aye

II.  Correspondence 
1.  CRMC Finding No Significant Impact to Sarah Torrey & Catherine Hoff,
36 Rand Place, Pittsfield, NY RE: construct maintenance repairs to the
existing structure by reshingling the roof and replacing windows as
needed, located at Plat 7/lot 88 at 20 Seaview Dr.  Received and
Acknowledged
2.  CRMC Finding No Significant Impact to Ron Lewis, 139 Seaside Dr. RE:
repair existing ISDS that has failed in accordance to plans submitted
proper sediment control measures should be adhered too, located at Plat
5/Lot 505, 139 Seaside Dr.  Received and Acknowledged
3.  CRMC Notice to the Estate of Carolyn Delmonico, 120 Long View Dr.,
West Greenwich to construct and maintain a residential boating facility to
consist of: a 4' x 150' fixed timber pier with 6 tie-off piles.
      The pier will be elevated 5-feet above mean high water and extend to
75-feet beyond mean low water and require a 25-foot length variance
pursuant to RICRMP Section 300.4 standards located at Plat 14/Lot 21, 1
Seaside Dr.  Received and Acknowledged
4.  RIDEM to Vincent Palumbo, PE, 2 Capitol Hill, Providence for an
insignificant Alteration Permit for an approved drainage system along the
Southwest Avenue DOT project.
5.  FYI - Copy of the Zoning Board Agenda for May 25, 1999.  Received and
Acknowledged

III.  Citizen's Non Agenda Item
Mary Levesque and Bob Counoyer addressed the Commission regarding storm
run-off inspection by the Town Engineer for the proposed Fox Run
Subdivision.
      Commissioner Hubbard stated that because it has not rained the Town
Engineer has not inspected the property.
      She asked Mr. Counoyer to stay in touch with the Planner and to come
back to the next meeting in June.

IV.  Reports
a.  Town Planner's Submitted Report
The Planner added that the Planning Department has hired an intern for the
summer to work on the Comprehensive Plan.
      His name is Jason Pezzullo.
      Also, the GIS is now installed and running.

b.  Town Committees
The Planner reported that the Parking Committee has been put into inactive
status.

c.   Sub Committees
With nothing to report move onto Old Business

V.  Old Business
1.  Maximum Size of Accessory Buildings
The Planning Commission discussed the issue and a motion was made, drafted
as per Commissioner Webster's request, by Commissioner Girard and seconded
by Commissioner Webster to add the following definition:
Swimming Pools (measured as the water surface) and Tennis Courts or other
permanent ball courts (measured by playing surface) shall be included in
calculating the lot coverage in Table 3-1.
      The outer fence of swimming pools or tennis courts shall be used for
determining setbacks from accessory lot lines.
      No lighting of private tennis courts or other permanent ball courts
is allowed.  The Commission recommended that the Planner polish up the
definition and have the Building Official review the definition before the
next meeting.

So voted:

Motion carried by a vote of 6-0

A motion was made by Commissioner Hubbard and seconded by Commissioner
Girard "to accept the following definitions:
  Accessory Building.
      Any building which, is customarily incidental and subordinate to the
principal building and does not share a common wall with the principal
building.
      An accessory building shall be located on the same zoning lot as the
principal building.

  Accessory Structure.
      Any structure constructed or erected which, is customarily
incidental and subordinate to the principal building.
      An accessory structure shall be located on the same zoning lots as
the principal building."

So voted:

Arthur Milot - Aye        Rob Lambert - Nay
Dennis Webster - Aye
Motion carried by a vote of 6-1

2.  Municipal Zoning
A motion was made by Commissioner Hubbard and seconded by Commissioner
Girard "to accept the Planner's recommendation to amend Section 1102
Applicability to include development plan review of certain municipal uses
in all the zones."  

After some discussion a motion was made by Commissioner Hubbard and
seconded by Commissioner Girard "that the Commission is in favor of the
general concept and to hand it back to the Planner to see if it will work
appropriately."  So voted:

Arthur Milot - Aye        Rob Lambert - Aye

Motion carried by a vote of 7-0

The Planner added that the Planning Commission should consider abutter
notification for Development Plan Review. 

VI.  New Business
With no New Business the meeting adjourned at 10:06 pm.
