Planning Commission Minutes
January 21, 1998
Town Hall

Meeting was called to order at 7:33 pm.
The following were present:
Betty Hubbard       Richard Waters

Also present:    Lisa Bryer - Town Planner

        Jim Estes - Hamilton Avenue Subdivision

I.  Reading and Approval of Minutes from January 7, 1998.
A motion was made by Commissioner Girard and seconded by Commissioner
Lambert to approve the minutes from January 7th as amended.  The
amendments are as follows:
page 1 - section I; Amend Commissioner's Girard, Lambert and Webster vote
to "Abstain".
Page 2 - section IV, #1; 4th line change to read "..., thus forgoing the
required cul-de-sac off Clinton Avenue."
          Add to second paragraph, last sentence "Jim Estes volunteered to
place a deed restriction on the large lot (lot 491A) so it would prevent
any further subdivision of the proposed duplex lot."

So voted:

Motion carries 7-0
II.  Correspondence
1.  CRMC AQUACULTURE ASSENT to Mr. & Mrs. Clyde Bryerly, 68 East Shore
Road, Jamestown; has applied to: Construct structural shoreline protection
facilities to consist of: 80 linear feet of vertical, reinforced concrete
seawall; located at Plat 7, Lot 86; 68 East Shore Road.
      Received and Acknowledged
2.  FYI: Copy of a letter to Diane Marksberry from the Zoning Board of
Review RE: December 17, 1997 decision.
      The Commission asked the Planner to look into  variance restriction
#1 and report back at the next meeting.

III. Citizens Non Agenda Items
With nothing at this time move on to Reports.

IV.  Reports
a.   Town Planner's Report - Submitted
b.   Town Committees
Harbor Management - Commission Webster reported that he had attended his
first Harbor meeting.
      The Harbor Commission requested to see the questionnaire regarding
the Comprehensive Plan before it goes out to the public.
      Commissioner Hubbard indicated that they were given 2 copies to
date.

FYI: Commissioner Hubbard stated that the Town Council will hear from
Chris Powell at their meeting on the 26th of this month regarding a Real
Estate Transfer Tax.
      A workshop will be held on this topic at the Library at 7:30 pm.
     on February 2.

V.   Old Business
1.  Hamilton Avenue - Major Subdivision
Commissioner Hubbard asked the Commission if they were inclined to grant a
waiver from Article IV, Section B.a (3)(b) to grant access from Clinton
Avenue and Hamilton Avenue.
      After some discussion on the question the Commission agreed.

Commissioner Hubbard then asked the Commission which check list would be
appropriate for Mr. Estes to follow.  After some discussion the Commission
agreed that many of the items on the Major Subdivision Checklists were not
applicable to this subdivision and that the Minor Subdivision check list
was most appropriate and would be used with the following additional
information:
a.  expanding checklist item # 2.14 to include mapping all trees 6" in
caliper 
 and larger within the limits of disturbance for each proposed lot;
       b.   verify the location of adjacent houses; and
b.  provide the Planning Commission with a draft of the Legal Document
      prohibiting future subdivision on the proposed duplex lot; and

A motion was made by Commissioner Hubbard and seconded by Commissioner
Waters to Utilize Minor Subdivision checklist #3 from the Subdivision and
Land Development Regulations with the addition of the following
information: (stated above).  So voted:

Gary Girard - Aye         Mary Brennan - Aye
Arthur Milot - Aye        Rob Lambert - Aye
Dennis Webster - Aye         Sue Barker - Aye
 Motion carries 8-0

A motion was made by Commissioner Webster and seconded by Commissioner
Girard to Combine the Master Plan and Preliminary phases of review,
including the Master Plan Informational Meeting and Preliminary Hearing.
      So voted:
Betty Hubbard - Aye       Richard Waters - Aye
Gary Girard - Aye         Mary Brennan - Aye
Arthur Milot - Aye        Rob Lambert - Aye
Dennis Webster - Aye         Sue Barker - Aye
Motion carries 8-0

The Commission then agreed to add the Fire Chief to the Technical Review
Committee when they review the property.
       The Commission asked the Planner to consult with the Technical
Review Committee on the matter of maintenance for the end of Clinton
Avenue and who's responsibility it is. 

A question was posed to whether Mr. Esters would combine lots b and c for
one combined driveway.
      Mr. Estes stated he would need to consult with the owners of the
property. 

2.  Comprehensive Plan Survey Questions
The Commission discussed the Comprehensive Plan and proposed suggested
changes to the Planner.
      The Commission will continue review of this at the next meeting.
 
VI.  New Business
With nothing at this time a motion was made by Commissioner Webster and
seconded by Commissioner Girard to adjourn the meeting adjourned at 10:05
pm.
