Meeting was called to order at 7:34 pm.
Roll was called and the following were present:

I. READING AND APPROVAL OF MINUTES from the meeting of January 15, 1997.
A motion was made by Commissioner Waters and seconded by Commissioner
Travisono to approve the minutes as written. So voted: 9-0.

II. CORRESPONDENCE
1. CRMC Modification of Assent A94-12-19 -- "AS BUILT" approval of
modification to a residential boating facility to consist of: 1) a 4' x
4' landing and ramp previously approved for the southwest side of the
dock (by assent modification on 10/6/95) was installed on the northeast
side of the dock, and the landing was constructed to 5' x 5'.
2) the originally approved 5' x 30' float has been constructed as
an 8' x 20' float.
The residential boating facility now extends to 68 feet beyond mean
low water (MLW) instead of 65-feet beyond MLW.
3) Two previously approved float restrain piles have been relocated
northeast and southwest of the as built float and are to be used as
tie-off piles.

2. CRMC to William J. Geib 76 Quaker Lane, West Warwick, RI 02893
RE: CRMC Preliminary Determination - File 97-1-4 (see New Business #3
for complete attached documentation). Move to New Business #3
3. CRMC Residential Assent File #96-10-28 Assent #A96-10-28 Whereas,
Linda Malouin 827 East Shore Road, Jamestown, RI 02835 has applied to
CRMC thereto: construct additions and renovations to an existing single
family dwelling.
Remove an existing driveway and construct a new permeable, crushed
stone driveway with a retaining wall.
Construct a new, timber, bank walkover structure and associated
landscaping on the property; located at plat 15, lot 212; 205 Seaside
Drive, Jamestown, RI. Received and Acknowledged
4. Copy of Correspondence from Richard Allphin to the Town Council cc:
Planning Commission RE: underground propane tanks Mr. Allphin stated the
present Zoning Ordinance allows the use of underground propane tanks.
A person does not need the Town's permission to install underground
propane tanks.
Jim Donnelly stated this was true because propane is not considered
a toxic material.
Mr. Allphin stated because propane is heavily regulated by the
Federal Government it has nothing to do with Zoning.
Planning Commission took this under advisement.

IV. REPORTS
Town Planner's Report
Commissioner Hubbard introduced Jane Weidman the new interim Town Planner
who officially started 1/17/97.
1. Memorandum RE: Mackerel Cove Heights - Planner stated she had
reviewed the Quattrocchi's application and found it incomplete.
2. Planner reported she has a new Certificate of Completeness form for
the Planning Office.
3. Planner has reviewed Cumberland Farm plans with Commissioner
Hubbard and Mr. Murphy. Updated plans should be in the Planning Office
by 1/19/97.
4. Planner reported she has completed two administrative
subdivisions, the Easton subdivision and the Jamestown Family Practice
subdivision.
She has 3 other projects involving Development Plan Review.

V. OLD BUSINESS
1. Town Administrator to discuss Planner position.
Planning Commission and Town Administrator discussed what they needed in a
Planner and if the position should be a full time, part time or on a
consultant basis.
A motion was made by Commissioner Brennan to recommend the Town hire a
full time Planner as soon as possible.
Commissioner Travisono made a motion to table the discussion because he
and others felt the topic should be discussed further at another meeting,
Commissioner Foley seconded the motion.
So voted: 4-5. Motion did not carry.

A motion was made by Commissioner Brennan and seconded by Commissioner
Bryer to recommend the Town hire a full time Planner as soon as possible.
So voted: 5-3. Motion carried.

Commissioner Hubbard suggested the Commission move directly to Mackeral
Cove Heights.
I. NEW BUSINESS
1. Letter to the Planning Commission from John Murphy RE: Jamestown
Learning Center. Withdrawn without prejudice
2. Mackerel Cove Heights request for major subdivision application to be
continued under old regulations after Commissioner Hubbard stated she
would hold voting until the Quattrocchi's were heard from.
Mr. DeCelles stated that Mackeral Cove Heights has been going on for 10
years and this petition is a continuation of the petition in 1986.
Minor details needed to be completed before coming back to the
Commission.
Then the Quattrocchi's had to go to court for water and sewer.
After litigation the subdivision was then involved with the
Narragansett Indian tribe because archeological artifacts were found on
the site. Now the subdivision can finally be completed.
Mr. Donnelly stated the litigation with the Board of Water and Sewer had
nothing to do with the Planning Commission.
An extension should have been written by the Quattrocchi's and given
to the Planning Commission.
Nothing was followed through with.
Mr. Donnelly also stated it was in his belief that the Quattrocchi's
should have to file their application to follow the new Subdivision
Regulations.
After more discussion a motion was made by Commissioner Waters and
seconded by Commissioner Milot to recommend Mackeral Cove Heights apply
under the new Subdivision Regulations. So voted: 8-1.

Commissioner Hubbard told the Quattrocchi's they have the option of coming
back and proving in a public meeting that their traditional subdivision is
best for the Town but at the same time they must have complete cluster
plans to prove that cluster type development is inappropriate.
Mr. James Quattrocchi stated he would talk to his engineer and surveyor.
He asked if he could be scheduled for the next agenda.
Commissioner Hubbard stated he would be placed on the agenda
providing all application items are in on time, complete, and reviewed by
the Planner.
The Quattrocchi's thanked the Planning Commission for hearing them on this
matter.

2. Proposed East Ferry DOT Ferry Service
Commission discussed the issue of parking downtown.
Commission requested the Planner find communities that may be
dealing with the same issues and find out how they have been addressed.
Planner stated she would have that for the Commission as soon as possible.
VI. NEW BUSINESS (cont.)
3. Copy of Correspondence and attached documentation to the Town
Administrator from Harbor Management RE: CRMC Aquaculture Permit
Application (CRMC File #97-1-14 PD) Proposed by William Geib, 76 Quaker
Lane, West Warwick, RI.
A meeting was scheduled for February 3 at 2:30 pm.
Commissioner Hubbard thanked all that attended.
