PLANNING COMMISSION MINUTES
April 17, 2002

The meeting was called to order and the following members were present:

A motion was made by Commissioner Brennan and seconded by Commissioner Barker to accept the minutes as written. So unanimously voted.
Commissioner Aibel arrives at 7:33 p.m.
Town Planner Lisa Bryer reminded the Planning Commission that the hearing for the Proposed Zoning Ordinance Amendment – Public Zone will be on Monday April 22,2002.
Councilor Willis asked the Town Solicitor Douglas DeSimone to look at lot 47 to see if it originally was included as "public facility" on the Future Land Use map. The large map clearly shows lot 47 was included. Town Planner, Lisa Bryer found the mylar that shows it and that the quality of the reproduction for the Comprehensive Plan wasn’t very good. The fact that lot 47 was included indicates that the 1991 Planning Commission and Council thought it was appropriate for a public facility.
Town Planner, Lisa Bryer asked the Planning Commission members to look at the proposed Bollards for the McQuades parking lot and stated that she will make a few suggestions to Mr. McQuade regarding these bollards. If the Planning Commission has suggestions or comments please let her know as this will be approved administratively.
Commissioner Hubbard asked the Town Planner about the proposed changes to the Water and Sewer regulations and asked if this issue could be put on the next Agenda. The Town Planner said she would put it on the next agenda.
Commissioner Schnack reported that the Harbor Commission is working on the Harbor Ordinance at this time. The Harbor Commission has asked the Harbormaster to look at the west side of Jamestown for mooring spots.
Town Council President Guy Settipane arrives at 8:01 p.m.
V. Old Business
This proposed Zoning Ordinance Amendment will now be known as Proposed Zoning Ordinance Amendment related to protection of Critical Water Resources. Town Solicitor Douglas DeSimone stated that this is the foundation of a good ordinance but wants to re-organize it. He asked for comments from the Planning Commissioners. A discussion ensued and the following comments were made: There should be a requirement for setback from wetlands within limitations. It does not address maximum fill for ISDS. Work needs to be done on definitions. Town Solicitor Douglas DeSimone will work on this and forward to Lisa Bryer, Town Planner.
A discussion ensued and the Town Solicitor stated that this proposed ordinance needs to be amended and brought in compliance with the Enabling Act. It was suggested that there should be merger districts. Town Planner Lisa Bryer will draft the areas and work with the solicitor in developing the ordinance. The Planning Commission will discuss this at a future meeting.
A motion was made by Commissioner Schnack and seconded by Commissioner Aibel to adjourn the meeting at 9:13 p.m. So unanimously voted.
