PLANNING COMMISSION MINUTES
August 1, 2001

The meeting was called to order at 7:33 p.m. and the following members
were present:

I.  Reading and Approval of Minutes from July 18, 2001
A motion was made by Commissioner Girard and seconded by Commissioner
Calabretta to accept the minutes with the following amendments:
Pg. 1 I. Reading and Approval of Minutes from June 20,2001. Victor
Calabretta - Aye Abstain

Pg. 1 III. Reports b. 2nd paragraph strike ordinance add Harbor Management
Plan.
So voted:

II.  Correspondence

1.  FYI - Statewide Planning Workshop - Summary of the Issues Discussed.
Received

2.  FYI - State Data Center - Census 2000 Community Profile. Received

3.  FYI - Memo from Town Clerk - Town Council Work Session - August
6,2001. Received

Commissioner Lambert informed the Planning Commission of the workshop and
stated that he will be attending the meeting.

III.  Citizen's Non Agenda Item

IV.  Reports

a.  Town Planner's Submitted Report 
Town Planner Lisa Bryer informed the Planning Commission that the release
of Bond was found for the Conanicut Reserve Subdivision and therefore will
not be discussed tonight.

b.  Town Committees 

Commissioner Webster reporting for the Harbor Management Commission stated
that the wharf repair work being done at West Ferry will be complete by
approximately October 15, 2001.  

Commissioner Webster asked the Planning Commission if they would like to
review the Harbor Management Plan at the next meeting.
      It will be placed on the agenda when it is ready for review.

c.  Sub Committees

Commissioner Barker gave a report to the Planning Commission regarding the
Tree Committee as did Commissioner Girard for the Parking Committee.

V.   Old Business

       1. Conanicut Reserve Subdivision - Approved by Planning Commission
- 9-29-76 - 

     Final Release of Bond

As reported from the Town Planner this Release of Bond was found in the
records.  No further action is needed.

VI.  New Business

1.  Dutch Harbor Boat Yard - Development Plan Review

Commissioner Brennan recused herself and left the table.
      Fred Lorensen presented the Planning Commission with the plans for
the Boat Yard building.
      He would like to use T1-11 for the siding instead of shingles.
      The shingle siding would cost $15,000.00 more than the T1-11 siding.
 The building would be painted yellow like it is now.
      A motion was made by Commissioner Calabretta and seconded by
Commissioner Barker to accept the T1-11 siding as proposed by Dutch Harbor
Boat Yard.  So voted:

                    Motion passes by a vote of 8-0

Commissioner Brennan returns to the table.

2.  Brown Estates - 3 lot Subdivision with waivers - East Shore Rd.

Mark Liberati, Attorney, and Robert Cournoyer presented the Planning Board
with the plans for this 3 lot subdivision.
      A discussion ensued regarding the waivers for the street, and
separate lot ownership.
      Commissioner Schnack made a motion that was seconded by Commissioner
Aibel to table this issue until a recommendation from the town solicitor
is received. Specific questions include issues relating to re-subdividing
an existing non conforming lot as well as, Do all lots proposed for
subdivision have to be in common ownership?  Also  to include the
following references from the Subdivision Regulations; page 10 Item 61
Definition of Subdivision, page 6 Item 28 definition of lot, page 7 Item
34 definition of parcel.  So voted:

3.  Ibis Estates - 2 Lot subdivision with waivers - East Shore Rd.

A discussion ensued regarding whether or not you can legally put a septic
system on a parcel next to you that is not under the same ownership.
      A motion was made by Commissioner Aibel and seconded by Commissioner
Webster to get an opinion from the solicitor about whether or not a
leaching field has to be on the same lot as the house or whether that
violates the intent of Article III A. 5. Of the Jamestown Subdivision
regulations.  So voted:

      Elaine Barone asked if the lots were merged together would it be
possible to do this?

A motion was made by Commissioner Aibel and seconded by Commissioner
Schnack to adjourn the meeting at 8:58 p.m.  All in Favor.
