Minutes of the Meeting

Charter Review Commission

09 April 2002

The seventeenth meeting of the Charter Review Commission began at 7:10 p.m. in the Police Station Conference Room on Tuesday, April 9, 2002. Peter Shocket was not able to attend; all other members were in attendance.A slight correction in wording was made in the minutes regarding the word "lieu" in line three, paragraph three, page 1; changed to "in light of recent events in Lincoln, RI"etc. Motion was made, seconded, and so voted that the minutes of the meeting of March 28, 2002, be accepted with the one word correction.Sav reported that the Town solicitor has stated that all gender and plurality changes must be included in the warrant by the Council and must be advertised.Section 702 - Planning and zoning - Appointment and term.

A discussion was held regarding the removal of the start-up language and reducing the number of members to the lowest possible size. A suggestion was made that appointments be renewed by the Council at appropriate intervals. This would help create better balances on committees, and give the Council a better awareness of who is on these committees.

Norma reminded us that "government should serve people instead of making them jump through hoops".

The Council could reappoint committee members after an election; a pro-active step to make better use of their services.Questions were raised in regard to the suggestion of reducing the number of people on the Planning Commission. Some felt smaller would be more efficient. As it is now, the Planning Commission outnumbers the Town Council, and some feel it seems to be a political body on itís own. A comment was also voiced that a smaller number would be less diverse.

* A motion was made, seconded, and so voted that part of this section should read:

"The Planning Commission shall consist of five (5) members who shall be appointed by the Town Council. There shall be two (2) auxiliary members, who shall sit as active members when and if a member of said Board is unable to serve at any meeting, and upon request of the chairman of said Board."

We will hold the question of length of term to be served for future study.Section 703 - Qualifications

* A motion was made, seconded and so voted that this section should read:

"Members of the Planning Commission shall be qualified electors and residents of the Town of Jamestown. No member of the Planning Commission shall be an elected or appointed official of the Town."

We decided to remove the phrase "to be known as the master plan" in (#1).

* A motion was made, seconded, and so voted that this should read:

"The preparation of, or extension of, a comprehensive community plan for the improvement of the Town."

* (#4) A motion was made, seconded, and so voted that this should read:

"Filing with the Town Council, annually, a report of itís activities and accomplishments"Section 706 - Appointment and tenure of the Zoning Board of Review

* A motion was made, seconded, and so voted that this section should read:

"The zoning Board of review shall consist of five (5) members appointed by the Town Council. There shall be three (3) auxiliary members of said zoning Board, who shall sit as active members when, and if, a member of said Board is unable to serve at any hearing, upon request of the chairman of said Board."Section 708 - Qualifications

* A motion was made, seconded, and so voted that members of this Board should be qualified residents of the Town of Jamestown.Section 709 - Conflict of Interest

* A motion was made, seconded, and so voted that this should read:

"Refer to section 209 - Conflict of Interest and Ethics."Section 803 - Annual Audit

This section needs to be studied in more detail.Section 804 - Conflict of Interest

* A motion was made, seconded, and so voted to read:

"Refer to section 206 - Conflict of Interest and Ethics."Sections 901 thru section 913 and also section 915: these all refer to start-up language of the Charter.

* A motion was made, seconded, and so voted to remove these sections from the Charter.We will revisit section 914 - in regard to residency and vacancy of elected official positions.We moved on to the discussion of new Article candidates.

Page 3. Article X - Charter ReviewWe have already voted that the review of the Charter will take place within six years of itís acceptance. Sav will research how the language of this article might read.

In regard to the fiscal year, we made a motion that was seconded and so voted to read: that the fiscal year will begin on July 1, like the rest of the State of R.I.We decided to postpone discussion of the financial Town Meeting until next meeting. We also will discuss committees being reappointed within 60 days of a new Council.A motion was made, seconded, and so voted to adjourn at 9:40 P.M..Dates for next meetings:
